Waivers
Waivers can help individuals who have been denied entry, green card status, or are currently in the country, but face deportation. We represent clients who need waivers for their situations. Waivers can be requested for the following reasons:
- Hardship Waiver: For individuals who have committed crimes; fraud; misrepresentation; or triggered the 3 and 10 year bars whose family members will suffer or experience hardship if denied entry or forced to leave the country.
- ***NEW FEDERAL RULE IS BEING PROPOSED WHICH WILL ALLOW THOSE INDIVIDUALS WITH U.S. CITIZEN SPOUSES AND PARENTS TO GET A WAIVER OF THE 3 AND 10 YEAR BAR WHILE STILL IN THE U.S. AND PRIOR TO THEIR VISA APPOINTMENT. THIS IS A VERY IMPORTANT NEW BENEFIT ALLOWING PEOPLE WHO ENTERED THE COUNTRY ILLEGALLY TO BECOME PERMANENT RESIDENTS.
- Cancellation of removal before an immigration judge for those who have resided in the U.S. for more than 10 years (7 years if a permanent resident) and can show extreme hardship to a spouse, parent or children who are permanent residents or a U.S. citizens.
